Please take 'employee' below to refer to all permanent or temporary staff employed directly by The Pensions Regulator (TPR) or seconded to TPR from other departments or private firms.

  • The number of investigations into allegations of sexual assault or inappropriate behaviour against employees for each individual year from 2012 until 2017, as well as for 2018 so far.
  • The number of employees against whom disciplinary proceedings for allegations of sexual assault or inappropriate behaviour have been started for each individual year from 2012 until 2017, as well as for 2018 so far.
  • The number of employees against whom disciplinary proceedings for allegations of sexual assault or inappropriate behaviour have been upheld for each individual year from 2012 until 2017, as well as for 2018 so far.
  • The number of investigations into allegations of bullying against employees for each individual year from 2012 until 2017, as well as for 2018 so far.
  • The number of employees against whom disciplinary proceedings for allegations of bullying have been started for each individual year from 2012 until 2017, as well as for 2018 so far.

I can confirm that we hold information which falls within scope of your request. However, we are unable to supply some of the requested information for the reasons set out below.

Information we are not able to supply

In line with TPR's retention policy we do not hold all of the requested data.

We retain information which relates to:

1. Ongoing HR investigations into allegations of sexual assault, inappropriate behaviour or bullying against employees.

2. Investigations into allegations of sexual assault, inappropriate behaviour or bullying against employees which are no longer ongoing and in which no formal action was taken. We retain copies of this information for one year from date on which our investigation was completed, in accordance with our retention policy.

3. Where an HR investigation into allegations of sexual assault, inappropriate behaviour or bullying against employees resulted in a formal warning being placed on a personnel file. We retain copies of first and second written warnings for six months and final warning letters for two years if this leads to dismissal, in accordance with our retention policy.

Information we are able to supply

The number of investigations into allegations of sexual assault or inappropriate behaviour against employees for each individual year from 2012 until 2017, as well as for 2018 so far.

TPR has conducted one investigation into allegations of sexual assault or inappropriate behaviour against employees within the 2017/18 financial year. We do not hold any records of investigations into such allegations for previous financial years.

The number of employees against whom disciplinary proceedings for allegations of sexual assault or inappropriate behaviour have been started for each individual year from 2012 until 2017, as well as for 2018 so far.

TPR has not started any disciplinary proceedings for allegations of sexual assault or inappropriate behaviour in any of the specified periods.
