Historical regulatory information for closed pension arrangements

Request

I request historical regulatory information held within the Pension Schemes Registry relating to the following closed occupational pension arrangement.

Primary Scheme

  • Scheme Name: Tankard Carpets Ltd Retirement Benefits Scheme
    • Pension Scheme Registry (PSR) Reference: 25461
    • Last Known Independent Trustee: PAN Trustee Services Limited (Company No. 03005366 – Dissolved)

To trace the complete transfer history and final destination of pension liabilities, this request also covers any master scheme records, bulk transfer documentation and winding-up records relating to the following sponsoring employers, all of which have been dissolved:

  1. Tankard Carpets Limited (Company No. 00769395) – Dissolved.
    • Historical payroll variants may include Tankards (Carpets) Ltd.
  2. Associated Weavers Limited (Company No. 00827289) – Dissolved.
  3. Weavercraft Carpets Limited (Company No. 01359432) – Dissolved.
    • Historically associated with Works Pension Scheme Registration S0328346K.
  4. Narang Textiles Limited – Dissolved.
    • Former Bradford textile business.

Information requested

Please provide the following information:

  1. The exact date on which the final winding-up deed, winding-up return, or equivalent scheme cessation documentation was recorded for Scheme No. 25461.
  2. The identity of any successor insurer, bulk annuity provider, or other organisation recorded within your systems as accepting the scheme’s liabilities, including:
    • bulk buy-out arrangements;
    • individual Section 32 buy-out policies;
    • or any other discharge mechanism relating to the above employers.
  3. Any historical registry status codes, administrative flags or equivalent records held in respect of:
    • Weavercraft Carpets Ltd Works Pension Scheme (Reference S0328346K); or
    • any pension arrangements associated with employer company numbers:
      • 00769395
      • 00827289
      • 01359432

Response

I have considered the situation and the entities involved. I confirm that we hold some of the information you have requested, however it is exempt from disclosure.

Section 44(1)(a) – restricted information under s82 PA04

Whilst the FoIA is based on the presumption of releasing information, section 44(1)(a) of the FoIA provides an absolute exemption to the requirement to disclose any information if its disclosure is prohibited by or under any enactment. In this case, section 82 of the PA04 prohibits disclosure and we are unable to disclose this sort of information. This exemption is absolute and does not require a public interest assessment be undertaken.

As we have been given strong powers to demand documents and other information from trustees, employers and others, those powers are also balanced by restrictions on how we disclose the information provided to us. The type of information you have requested would be ‘restricted information’. Restricted information is defined at section 82(4) of the Pensions Act 20042 (PA04) as:

‘…information obtained by the Regulator in the exercise of its functions which relates to the business or other affairs of any person’.

Under section 82(5) of the PA04 it is a criminal offence to disclose such information except as permitted under that Act.
