Duty to confirm or deny whether we hold the information requested

We have carefully considered your request for information. For the reasons outlined below we can neither confirm nor deny that we hold information falling within the description specified in your request.

The type of information you have requested would be ‘Restricted Information’. Restricted Information is defined at section 82(4) of the Pensions Act 2004 (PA04) as:

‘…information obtained by the Regulator in the exercise of its functions which relates to the business or other affairs of any person’.

Under section 82(5) of the PA04 it is a criminal offence to disclose such information except as permitted under that Act.

Whilst the FoIA is based on the presumption of releasing information and sets out a requirement on the public authority to confirm if it holds the information requested (section 1 (1) (a) and (b)), there are exceptions to these rights.

One of these exemptions is section 44 of the FoIA. Under section 44 (2) of FOIA a public authority does not have to confirm or deny whether it holds the information requested if doing so is prohibited under another enactment (Act).

In this instance, the information you have requested is the type of information, which if held, would fall under the definition of Restricted Information and therefore TPR have determined to respond to your request on this basis. This exemption is absolute and does not require a public interest assessment be undertaken.
