Under the Freedom of Information Act, I request that The Pensions Regulator provide the following information from the case files of TM6882:

The name and contact details of the replacement Independent Trustee(s) or Administrator(s) legally appointed by the Regulator to govern and manage the assets of the Reydel Limited Works Pension Scheme following the 2011 Determination.
If the scheme has since been transferred, wound up, or merged into another vehicle following the FCA/TPR asset recovery actions, please provide the name of the current entity or financial institution holding the remaining liabilities and member records for the Reydel scheme.

Response to Part 1

I can confirm that we hold this information. However, it is exempt from disclosure under Section 21 of the FoIA. This is because the information is accessible to you, as it is already in the public domain.

In the notice linked above, The Panel determined an order that Pitmans Trustees Limited (PTL) be appointed as trustee of The Reydel Limited Works Pension Scheme. PTL was acquired by ZEDRA in January 2022.

Section 44(1)(a) – restricted information under s82 PA04

Whilst the FoIA is based on the presumption of releasing information, section 44(1)(a) of the FoIA provides an absolute exemption to the requirement to disclose any information if its disclosure is prohibited by or under any enactment. In this case, section 82 of the PA04 prohibits disclosure and we are unable to disclose this sort of information. This exemption is absolute and does not require a public interest assessment be undertaken.

Under section 44(2) of FOIA a public authority does not have to confirm or deny whether it holds the information requested if doing so is prohibited under another enactment.

As we have been given strong powers to demand documents and other information from trustees, employers and others, those powers are also balanced by restrictions on how we disclose the information provided to us. The type of information you have requested would be ‘restricted information’. Restricted information is defined at section 82(4) of the Pensions Act 2004 (PA04) as:

‘…information obtained by the Regulator in the exercise of its functions which relates to the business or other affairs of any person’.

Under section 82(5) of the PA04 it is a criminal offence to disclose such information except as permitted under that Act.
